Court Dismisses PAM’s Application

Agents of PAM were seeking to have the High Court overturn the decision of Registration Officer Wingrove Archibald, who had disallowed PAM’s agent, Ms. Terrelah Byron’s objections to the inclusion of the name of Ameya Okori (a citizen of a Commonwealth nation) and others on the January 31, 2012 register.

Ms. Byron was represented in court by lawyer Jonel Powell, who is also a Deputy Chairman of the PAM.

Powell is reported to have also represented Mr. Rupert Earle of PAM’s Central Basseterre Executive Branch, who similarly was appealing the decision of the same Registration Officer who also disallowed Earle’s objection to the inclusion of the name of Christine Opeoluwa Oyebefun (another citizen of a Commonwealth nation) and others on the same register.

The initial objections were filed by PAM agents to names which were included on the register and those objections were disallowed by the Registration Officer. The law says all such appeals must be filed in 7 days of the decision. The decision was given on May 29, 2011 but the appeal was filed on June 14, 2012.

Counsels for the Registration Officer were Sylvester Anthony and John Tyme from the Attorney General’s Chambers.

Attorney Sylvester Anthony said that, “both appeals were struck out for having been filed out of time”. The Court granted my application with costs to be agreed by August 21st otherwise to be assessed”.
